GENERAL TERMS AND CONDITIONS (Effective October 2025)

This document forms part of the Charter Agreement between Solrise Private Limited (“Operator”) and the Charterer (“Client”). By confirming the booking and paying the deposit, the Charterer agrees to the following terms and conditions:

1. Definitions Operator: Solrise Private Limited, the owner or authorized manager of the vessel. Charterer: The person or entity making the booking. Vessel: The catamaran or yacht specified in the Charter Agreement. Guests: All persons listed under the booking. Charter Fee: The total price agreed for the charter.

2. Cancellation by Charterer – More than 60 days before departure: No cancellation fee. – 30–60 days before departure: 50% of the total charter fee. – 30 days or less before departure: 100% of the total charter fee. All cancellations must be made in writing.

3. Cancellation by Operator If the Operator cancels for any reason other than Force Majeure, the Charterer will receive a full refund of all payments made, without interest or penalty.

4. Sale of Vessel If the vessel is sold, the new owner shall honor the confirmed charter under the same terms. If the buyer refuses, the Operator will refund the Charterer in full, and no further claims shall be made.

5. Included Services As listed in the itinerary or quote, including skipper, chef, meals, limited fuel and generator use, transfers, and basic amenities.

6. Excluded Services Taxes, service charge, alcoholic beverages, motorized water sports, diving/surfing, gratuities, and other personal expenses unless expressly stated.

7. Force Majeure Events such as natural disasters, war, government restrictions, pandemics, or other circumstances beyond the Operator’s control may prevent fulfillment of the charter. In such cases, the Operator will: – Offer rescheduling subject to availability, or – Provide a full or partial refund (excluding bank or transfer fees). The Operator will not be liable for additional costs or consequential losses.

8. Health and Fitness The Charterer confirms that all guests are medically fit for participation. The Operator must be informed of any medical conditions prior to departure. The Operator may restrict participation in certain activities if necessary for safety reasons.

9. Liability Waiver Participation in water and sailing activities carries inherent risks. Guests agree that the Operator, its employees, and affiliates are not liable for injury, loss, or damage arising from participation, except in cases of proven negligence or willful misconduct.

10. Children Policy Children under 8 years require prior approval. Parents or guardians are fully responsible for their supervision and safety.

11. Insurance The vessel is insured for marine and public liability. The Operator’s insurance does not cover guest injury, loss, or damage to personal belongings. Charterers are advised to obtain comprehensive travel insurance including medical evacuation, trip interruption, and personal effects coverage.

12. Accidental Damage The Charterer is liable for any damage to the vessel or equipment caused by their actions, excluding normal wear and tear.

13. Authority of Captain and Crew The captain has full authority regarding vessel operation, navigation, safety, and itinerary adjustments. Guests must follow all instructions.

14. Itinerary and Route Changes The Operator reserves the right to alter routes or schedules for weather, safety, or operational reasons. No refunds will be made for such changes.

15. Safety and Conduct Guests must: – Attend safety briefings and follow crew instructions. – Wear life jackets as required. – Refrain from smoking in prohibited areas or engaging in unsafe behavior. The Operator may terminate the charter without refund for gross misconduct or illegal activity.

16. Emergency Procedures Guests must follow captain and crew instructions promptly during any emergency.

17. Environmental Responsibility Guests shall not dispose of waste into the sea and must avoid activities harmful to the marine environment. Compliance with onboard sustainability practices is mandatory.

18. Compliance with Laws Guests must comply with all applicable Maldivian laws. Any illegal acts (including drug possession or use) will result in immediate termination without refund and may lead to legal prosecution.

19. Limitation of Liability To the maximum extent permitted by law, the Operator’s total liability for any claim shall not exceed the total charter fee paid.

20. Dispute Resolution and Governing Law This Agreement shall be governed by the laws of the Republic of Maldives. Any disputes shall first be settled amicably; failing which, the matter shall be referred to arbitration in Malé, Maldives, in English.

21. Acceptance Payment of deposit constitutes full acceptance of these Terms and Conditions by the Charter
